FIRED FROM YOUR JOB?
California is an at-will-employment jurisdiction. However, getting fired from your job can still be wrongful in certain situations. Our team of wrongful termination attorneys has a track record of securing substantial settlements, and we’re ready to assist you. Act quickly—call ***-***-**** for a FREE case evaluation.
What is At-Will Employment?
In California, your job can be ended by you or your employer at any time and for any reason. Even if you’re doing great at work, your employer can still let you go without giving a specific reason.
Despite the general at-will employment regulations, there are exceptions that limit when employers can fire you. Employers must follow public policies, company rules, contracts, and other guidelines. In addition, there are several at-will job termination exceptions that California courts have determined to be unconstitutional, such as:
Discrimination/Harassment: Firing someone based on protected traits like race, religion, gender, age, ability, sexual orientation, or political beliefs is not allowed.
Retaliation: You can’t be fired for reporting your employer’s illegal activities, and your employer can’t fire you for refusing to do something against the law.
Protected Absences: Legitimate reasons for taking time off, like jury duty or family emergencies, are protected from termination.
Constructive Discharge: Courts also consider unlawful employer conduct when they create (or fails to remedy) hostile working conditions that force an employee to quit.
STAY CALM… AVOID EMOTIONAL REACTIONS!
